Day One Feed operates strictly as a data aggregator and provider. We do not initiate calls, send emails, or deploy text messages on behalf of our clients. By subscribing to our service, you agree to adhere to all applicable marketing and telecommunications laws.

1. Telephone Consumer Protection Act (TCPA)

You agree to fully comply with the TCPA and all related FCC regulations. You understand that our data feeds may contain direct mobile phone numbers. You agree not to use an Automatic Telephone Dialing System (ATDS), pre-recorded voice messages, or automated SMS text messaging to contact any number provided by Day One Feed without obtaining the prior express written consent of the recipient, as required by law.

2. National Do Not Call (DNC) Registry

Day One Feed provides raw, appended registration data. We do not scrub our daily feeds against the National Do Not Call (DNC) Registry or state-level DNC lists. It is your sole responsibility to scrub any data purchased from us against all applicable federal, state, and internal DNC lists before initiating any telemarketing calls.

3. CAN-SPAM Act Compliance

If you utilize the email addresses provided in our feed for outreach, you must comply with the CAN-SPAM Act. This includes, but is not limited to, providing a clear and conspicuous opt-out mechanism, honoring opt-out requests promptly, avoiding deceptive subject lines, and including your valid physical postal address in your communications.

4. Indemnification

By using our service, you agree to indemnify, defend, and hold harmless Day One Feed, its officers, directors, and employees from and against any and all claims, lawsuits, fines, penalties, or damages (including attorney's fees) arising out of or related to your use of the data, including but not limited to any alleged violations of the TCPA, CAN-SPAM, or state telemarketing laws.

5. Account Termination

We reserve the right to immediately terminate the subscription of any user found to be using our data to conduct illegal, fraudulent, or harassing activities.
